Employees serving in a uniformed service are protected under USERRA regardless of whether the service is voluntary or involuntary. USERRA protects individuals not only on active duty but also inactive duty and prohibits discrimination and retaliatory action against employees who are currently serving, who have served, or who have applied to serve in a uniformed service.

USERRA requires employers to grant leaves of absence to any employee serving in a uniformed service and requires reinstatement to his or her position following the leave of absence. This includes receiving any promotions he or she would have received during the leave of absence and maintaining that employee's seniority. In addition, USERRA protects employees who have become disabled during their service in the military by requiring employers to provide reasonable accommodations. Under the protection of USERRA, employers cannot terminate a returning uniformed service employee without just cause for up to one year.
